We Help Injured Health Care Workers Recover Damages

Despite what many people think, working in the health care industry can be a dangerous occupation. In our practice, we work with many people in the nursing and home health care profession who have suffered a serious injury on the job.

If you need help understanding your right to compensation for an accident suffered while working at a hospital, nursing home or a patient's residence, contact an attorney at the law firm of Allison & Ward in Austin.

How much you can collect for a health care accident depends on many factors. Obviously, the amount you recover should reflect the severity and extent of your injury, as well as how long you will be away from work. Another important factor, however, is whether you can file a lawsuit for all of your personal injury damages, or whether you'll be limited to the lesser amounts available under the Texas workers' compensation system.

Workers' comp usually only covers lost income and medical expenses. For the most serious injuries, it will also assign you an impairment rating that gives you three weeks' salary for each percentage point of impairment. For example, if you are found to have a 10 percent impairment, you'll get 30 weeks of pay.

As your job-related injury lawyers, we work to make sure that you collect as much as you can from whatever source is available to meet your claims. While we're helping you with your workers' compensation claim, we also see if you can also file a lawsuit for personal injury damages against the parties responsible for your accident. Although every case is different, the recovery for a personal injury claim is usually greater than a workers' compensation case. In some cases, we can help you get both.

Health care accidents can occur from lifting overweight or bedridden patients, injuries caused by defective equipment, or falls in congested corridors or badly maintained residential settings. Whether your problem is a back injury such as a herniated disc, soft tissue damage in a shoulder or wrist, or blunt force trauma in a job-related vehicle accident, we can make an accurate estimate of the value of your claims and go to work to resolve them.

We represent foreign health care workers regardless of visa status

Many nursing or home health care assistants come from Latin America or overseas. Our attorneys can advise and represent you about injury claims regardless of your visa status or documentation. You don't have to worry about immigration problems if you are hurt on the job.
