Understanding the Laws on Cellphone Use and Texting

In 2009, the city of Austin passed an ordinance prohibiting electronic messaging while driving. Specifically, the law makes it illegal to view, send or compose a text message while driving. It also makes it illegal to use your phone to browse the Internet while driving. However, drivers are still allowed to dial and talk on the phone.

Outside of Austin, the Texas state law governs. For drivers over the age of 18, the state law only bans talking and texting while in school zones. Drivers younger than 18 are completely banned from using texting and talking on cellphones while driving. There are some special provisions that apply to bus drivers as well.
